UNDER AND BY VIRTUE of the authority contained in a
certain Order entered by the Honorable Julia Byrd, Assistant Clerk of
Superior Court for the County of Wilkes on the 14th day of September
2012, in a special proceeding therein entitled In the Matter of the
Estate of Nancy Sue Prevette, designated as 2012 SP 47, the undersigned
Commissioner, by and through Great State Auction Company and, in
particular, Randall Woodruff, will on Friday, October 19, 2012, at 2:00
p.m. on the grounds of the said real property, specifically, 6907 Elkin
Highway 268, North Wilkesboro, North Carolina, offer for resale to the
highest bidder for cash, that certain tract or parcel of land located
in Rock Creek Township, Wilkes County, North Carolina, and more
particularly described as follows:
FIRST TRACT: BEGINNING on a stake on the north side of Highway No. 268
at the intersection of a 60 foot road with Highway No. 268 and runs
North 43º 45’ East along the west side of the 60 foot road 147 feet to
a stake; thence continuing with the west side of said 60 foot street,
North 31º 15’ East 60 feet to a stake; thence North 66º West 112 feet
to a stake; thence South 29º 45’ West 200 feet to a stake on the north
side of Highway No. 268; thence with the north side of Highway No. 268,
South 66º East 75 feet to the point of beginning, being a lot out of
the lands described in the deed from Absher Real Estate Company, Inc.
to Clyde G. Cothren, et al.
For further reference, see Deed Book 587, Page 620; Book 448, Page 432 and Book 433, Page 176, Wilkes County Registry.
SECOND TRACT: BEGINNING on an iron stake on the north margin of Highway
No. 268, Joe Byrd’s southwest corner and running along his line, North
29º 45’ East 300 feet to an iron stake, his corner; thence North 66º
West 115 feet to an iron stake at the southwest corner of Juanita
Sparks’ lot; thence South 18º 20’ West 201 feet to an iron stake on
north margin of Highway No. 268; thence South 66º East along highway
75.5 feet to the point of beginning, containing 19,000 square feet,
more or less, and being a part of a tract of land described in Book
423, Page 536 of the Wilkes County Registry.
This resale is subject to ad valorem taxes and such other liens as may appear of record.
1. The property to be offered pursuant to this notice
of sale is being offered for sale, transfer and conveyance “AS IS,
WHERE IS.” The Commissioner makes no
representations or warranties relating to the title or any physical,
environmental, health or safety conditions existing in, on, at or
relating to the property being offered for resale, and any and all
responsibilities or liabilities arising out of or in any way relating
to any such condition expressly are disclaimed. This resale is made
subject to all prior liens and encumbrances, and unpaid taxes and
assessments.
2. The successful (highest) bidder shall be required
to make a cash deposit at the time of resale in the amount of 5% of the
highest bid. Any successful bidder shall be required to tender the full
balance of the purchase price so bid, including the five percent (5%)
buyer’s premium as set out hereinafter, in cash or certified check at
the time the undersigned Commissioner tenders, or attempts to tender,
to the successful bidder, a deed for the property. Should the
successful bidder fail to pay the full balance of the purchase price so
bid at that time, and the five percent (5%) buyer’s premium, the
successful bidder shall remain liable on the bid as by law provided.
3. This resale shall be held open for upset bids as by law provided.
4. This resale is made pursuant to Chapter 1, Article 29A of the North Carolina General Statutes.
5. Randall Woodruff of Great State Auction Company is
the agent of the undersigned Commissioner. Broker and seller have
agreed that this resale is to be conducted by including a buyer’s
premium of five percent (5%) upon the final high bid price accepted by
the Court. The actual contract sales price shall be the sum of the
confirmed high bid plus the buyer’s premium of five percent (5%) of
said high bid. Any bidder acknowledges and agrees that inclusion and/or
payment of the buyer’s premium shall not make broker the agent of the
bidder/buyer and that the broker continues as the agent of the
Commissioner in the sale of said property.
6. The successful bidder’s inability to secure a loan
for the balance of the sale proceeds is not an excuse to void the
sale/purchase.
