     UNDER AND BY VIRTUE of the authority contained in a certain Order entered by the Honorable Julia Byrd, Assistant Clerk of Superior Court for the County of Wilkes on October 17, 2017, in a special proceeding therein entitled James W. Pennell, Sr. by Zolorest P. Brennan, General Guardian, Petitioner vs. Zorrest P. Millman; James W. Pennell, Jr. and wife, Jewel Pennell, Respondents, designated as 2017 SP 201, the undersigned Commissioner, by and through Great State Auction Company and, in particular, Randall Woodruff, will on November 11, 2017, at 12:00 noon on the grounds of the property described herein located at 398 Green Acres Road, Millers Creek, NC 28651, that certain tract or parcel of land located in Reddies River Township, Wilkes County, North Carolina, and more particularly described as follows:
LYING and BEING in Reddies River Township, Wilkes County, North Carolina
PARCEL ID:  1502936

BEGINNING on an iron stake on the West margin of State Road No. 1337 at a point North 0° 07’ East 60.78 feet from the Northeast corner of the Raymond Delp lot and running along the road North 0° 07’ East 100 feet to an iron stake; thence continued with the Road North 1° 00’ East 50 feet to an iron stake; thence leaving the road and running South 86° 49’ West 218.22 feet to an iron stake, Conrad Vannoy’s corner; thence along his line South 3° 23’ West 174.41 feet to an iron stake on a 60 foot road; thence North 80° 56’ East along the road 230 feet to the point of beginning, containing 35,879.59 square feet, more or less, and being a part of the tract of land described in deed recorded in Book 444, Page 115, Wilkes County Registry. Being Lot 6 in Block 2 of the subdivision known as Green Acres, as shown and described on a map thereof, recorded in Map Book 5, Page 111, Wilkes County Registry.

The above-described property is conveyed subject to the restrictions as follows:

(1)    The property shall be used as residential purposes only.
(2)    No residence shall be built containing less than 1200 square feet of living space.
(3)    No house trailers shall be located thereon for living purposes.
(4)    No building shall be constructed using concrete blocks showing above ground level.
(5)    No livestock or poultry shall be kept on the property with the exception of household pets.

This sale is subject to ad valorem taxes and such other liens as may appear of record.
1.    The property to be offered pursuant to this notice of sale is being offered for sale, transfer and conveyance “AS IS, WHERE IS.” The Commissioner makes no representations or warranties relating to the title or any physical, environmental, health or safety conditions existing in, on, at or relating to the property being offered for sale, and any and all responsibilities or liabilities arising out of or in any way relating to any such condition expressly are disclaimed. This sale is made subject to all prior liens and encumbrances, and unpaid taxes and assessments.
2.    The successful (highest) bidder shall be required to make a cash deposit at the time of sale in the amount of five percent (5%) of the highest bid. Any successful bidder shall be required to tender the full balance of the purchase price so bid, including the five percent (5%) buyer’s premium as set out hereinafter, in cash or certified check at the time the undersigned commissioner tenders, or attempts to tender, to the successful bidder, a deed for the property. Should the successful bidder fail to pay the full balance of the purchase price so bid at that time, and the five percent (5%) buyer’s premium, the successful bidder shall remain liable on the bid as by law provided.
3.    This sale shall be held open for upset bids as by law provided.
4.    This sale is made pursuant to Chapter 1, Article 29A of the North Carolina General Statutes.
5.    The successful bidder’s inability to secure a loan for the balance of the sale proceeds is not an excuse to void the sale/purchase.
6.    This sale is specifically made subject to confirmation of the Clerk of Superior Court.
