NOTICE OF RESALE

UNDER AND BY VIRTUE of the authority contained in a certain Order
entered by the Honorable Julia Byrd, Assistant Clerk of Superior Court
for the County of Wilkes on the 7th day of December, 2016, in a special
proceeding therein entitled “In the Matter of the Estate of Emma Lou
Long, Gary A. Long, Executor,” designated as 16 SP 192, the undersigned
Commissioner will on Friday, February 3, 2017, at 2:00 p.m., on the
grounds of the said real property, specifically those certain two (2)
tracts or parcels of land located at 916 K Street, North Wilkesboro,
North Carolina, North Carolina, offer for sale to the highest bidder
for cash, those certain tracts or parcels of land located in North
Wilkesboro Township, Wilkes County, North Carolina, recorded in Book
542 at Page 923 of the Wilkes County Registry, Parcel #1401811, and
recorded in Book 545 at Page 847 of the Wilkes County Registry, Parcel
#1401812, more particularly described as follows:
TRACT 1:
BEGINNING at a point on the north side of Winstead
Street 120’ Westward from the intersection of the north boundary of
Winstead Street and the west boundary of Glenn Street; then running S
62° 33’ W along the north side of Winstead Street 90’ to a stake; then
running N 27° 27’ W 80’ to a point; then running N 62° 33’ E 90’ to a
stake; then running S 27° 27’ E 80’ to the north boundary of Winstead
Street, the point of Beginning, containing approximately 7,200 square
feet, said property being all of Lot 5 and the eastern half of Lot 7 of
Block 211, as shown on Trogdon’s Map of North Wilkesboro, North
Carolina, as recorded in the office of the Register of Deeds of Wilkes
County in Map Book a at Page 19.
TRACT 2:
The grantors, Charlie Higgins and wife, Bessie
Higgins, are the owners of the eastern ½ of Lot 4, Block 210 and all of
Lot 3, Block 210, of the property platted in Trogden’s Map of North
Wilkesboro as recorded in the Wilkes County Registry. Adjacent to
this lot was a road known as Winstead Street. Winstead Street was
closed by Order of the Commissioners of the Town of North Wilkesboro as
recorded in Book 545 at Page 534 of the Wilkes County Registry.
Upon its closing, the southern ½ of Winstead Street bordering the
eastern ½ of Lot 4, Block 210, and all of Lot 3, Block 210, became the
property of Charlie Higgins and wife, Bessie Higgins. It is the
intent of Charlie Higgins and wife, Bessie Higgins, to hereby convey to
Bronard Long and wife, Emma Lou Long, all right, title and interest
with they now have in the southern ½ of Winstead Street which borders
the eastern ½ of Lot 4, Block 210, and all of Lot 3, Block 210.
This sale is subject to ad valorem taxes and such other liens as may appear of record.
1. The property to be offered pursuant to this notice
of sale is being offered for sale, transfer and conveyance “AS IS,
WHERE IS.” The Commissioner makes no representations or
warranties relating to the title or any physical, environmental, health
or safety conditions existing in, on, at or relating to the property
being offered for sale, and any and all responsibilities or liabilities
arising out of or in any way relating to any such condition expressly
are disclaimed. This sale is made subject to all prior liens and
encumbrances, and unpaid taxes and assessments.
2. The successful (highest) bidder shall be required
to make a cash deposit at the time of sale in the amount of 5% of the
highest bid. Any successful bidder shall be required to tender
the full balance of the purchase price so bid, including the ten
percent (10%) buyer’s premium as set out hereinafter, in cash or
certified check at the time the undersigned Commissioner tenders, or
attempts to tender, to the successful bidder, a deed for the
property. Should the successful bidder fail to pay the full
balance of the purchase price so bid at that time, and the ten percent
(10%) buyer’s premium, the successful bidder shall remain liable on the
bid as by law provided.
3. This sale shall be held open ten (10) days for upset bids as by law provided.
4. This sale is made pursuant to Chapter 1, Article 29A of the North Carolina General Statutes.
5. Randall Woodruff of Great State Auction Company is
the agent of the undersigned Commissioner. Broker and seller have
agreed that this sale is to be conducted by including a buyer’s premium
of ten percent (10%) upon the final high bid price accepted by the
Court. The actual contract sales price shall be the sum of the
confirmed high bid plus the buyer’s premium of ten percent (10%) of
said high bid. Any bidder acknowledges and agrees that inclusion
and/or payment of the buyer’s premium shall not make broker the agent
of the bidder/buyer and that the broker continues as the agent of the
Commissioner in the sale of said property.
6. The successful bidder’s inability to secure a loan
for the balance of the sale proceeds is not an excuse to void the
sale/purchase.
